Jurors ruled that officer Douglas Stephenson was justified when he shot Scott Luty during a domestic dispute.
The whole thing happened just blocks away from the Frederick police station two months ago.
Officers said Luty shot his wife in the head then started firing at police.
He was hit once in the chest but he also turned the gun on himself. Lutys wife, Jennifer, survived her injuries.

The Humane Society of Washington County said you should be aware of where your pet is at all times.,"Officials said you should not leave your pet in your car.
"I know a lot of people leave their cars running. If something happens and your car shuts off or it overheats, or stops working; you dont have that to rely on. Its just safer to leave your dog at home, your animal at home. If you can get it inside, bring it inside," said Paul Miller, from the Humane Society of Washington County.
"Put it in the garage, somewhere where its cooler, plenty ventilation, plenty of water. I would advise everybody, especially if your dogs are outside this time of year to place twice the amount of water that you normally have," said Miller.
"Make sure its secure, that they cant knock it over. We get a lot of cars from people saying they put buckets of water out. The dog will dig at it with its paw and knock the bucket over and then they are without water," said Miller.
