The decision came on Monday. Prosecutors will be allowed to review Morris medical history from both the Maryland Division of Corrections and Washington County Hospital. Morris had been a patient at the hospital when he allegedly shot Jeffery Wroten who had been guarding him.
State prosecutors said they are still trying to get access to the rest of Morris records.
Charles Strong, a Washington County States Attorney, said "At this time for pretrial purposes the court denied the states request for some education records, and for some juvenile records."
If Morris is convicted of first degree murder, prosecutors said they will ask for the death penalty.
