The prosecutor drew a play-by-play of what happened on March of 2011. Prosecutor Pamela Games-Neely told the jury Jonathan Bennett's then girlfriend, Ashley Carpegna had propositioned three men at an exotic dance club in Martinsburg where she worked.
Prosecuctor Games-Neely said Carpegna and the men went to her apartment on Winchester Avenue when one of the men didn't keep his part of the deal. Bennett came out of a room and shot Geronimo Garcia-Cruz in the head.
The defense says Bennett had been out of town and Carpegna never knew he was home. The defense also says Bennett acted in self-defense when he shot Garcia-Cruz.
Both attorneys say the men didn't go to police because they're were living here illegally. The other man, Omar Navarro, and Carpengna are scheduled to take the stand on Friday.
Carpegna is testifying against Bennett as part of a plea agreement.
