In a press release Wednesday, D.A. Matt Fogal says he filed a notice of aggravating circumstances against Carl Varner. The document will allow prosecutors to ask for the death penalty.
Carl Varner pleaded not-guilty on all 28 counts Wednesday in court.
Varner is accused of killing 29-year-old Victor Hugo Campos-Olguin during a home invasion robbery in October on East King Street.
