Man Sentenced to 40 years in Prison after Shootout

FREDERICK COUNTY, MD - In Frederick County Circuit Court, a Howard County man has been
sentenced to 40 years in prison after being convicted of shooting a man,
before firing at a Frederick police officer.
A jury found Charles Moore, 28, of Woodbine, guilty in September of one count each of attempted first and second-degree murder and use of hand gun in a violent crime.
It was Moore's third trial in the 2005 shooting of Romell Allen, of Virginia, and shootout involving Frederick Police Sgt. Wayne Trapp at County Hills Apartments on Heather Ridge Drive.
Moore was found guilty of attempted first-degree murder and other charges in January 2006 and was sentenced to life plus 20 years, but his conviction was overturned because of jury selection problems.
Moore's second trial in July 2011 ended in a mistrial when the jury could not reach a unanimous verdict.
Police say Moore went to the apartment complex in the early hours of May 20, 2005, and became involved in a fight involving two groups of people he said he did not know. Moore shot Allen three times and seriously wounded him, collapsing his lung and causing him to loose a kidney.
Judge William Nicklas Jr. gave Moore 30 years on each of the attempted-murder counts, suspending all but five years on one count, and 20 years on the weapons charge, suspending all but five years.
The unsuspended time will be served consecutively, but Moore will receive credit for the more than seven years he has spent in jail since the crime. Nicklas ordered that Moore serve at least half of his sentence because the shooting is a violent crime.
