"One, we believe a jury can be selected that is fair and impartial, and two, that the defendant has failed to comply with the requirement that the defendant himself personally sign under oath the request for removal," said Charles Strong, Washington Count

The hot topic of growth is enough that residents are suing the county over their development plans. Residents living in and around New Market said the infrastructure isnt ready if the population doubles. "We wont be able to get out of our community or into it. Theres only one road," said Marion Griffin, New Market resident. Griffin is one of 50 homeowners suing Frederick County over the New Market regional plan, which outlines growth over the next 15 years. Residents said the Board of County Commissioners ignored their opposition - saying 14,000 new homes would overwhelm the area and the plan doesnt meet state planning requirements. "The plan was flawed from the beginning. Nobody stopped to fix it and the concerns of the citizens were ignored," said Jason Dean, Plantiff. "We werent being represented. The process wasnt being represented, and it wasnt legal," said Robert Glasby, Plantiff. "The hype over 14,000 new homes is simply not true, never was true, not true today," said Mike Cady, Frederick County Commissioner. Some residents said sometimes it takes an hour to travel from New Market to Frederick using Old National Pike. Under the regional plan, the travel time will only get worse. Marylands primaries are less than a week away, and County Commissioner Mike Cady said the folks bringing the suit have a different agenda. "I think this was a strategy on the part of those filing the suit to make it a campaign issue, more so than it already is," said Cady. "We had to wait until they took their final action. When they did that on Tuesday, we filed our action the next day," said Jim Jamieson, Friends of Frederick County. Whether it was a political move or not, four candidates for county commissioner were on hand to meet with the plaintiffs and each promised to try to take a more measured approach if theyre elected. The vote to approve the New Market regional plan wasnt unanimous. Board President Lennie Thompson and Commissioner Jan Gardner voted against it. Commissioners Mike Cady, Jim Lovell, and Bruce Reeder voted in favor of the regional plan.
