Higher Court Throws out Penn-Mar's Appeal

The ethanol plant is no more. The higher court decided that the developers of the plant didnt have a leg to stand on. The Citizens for a Quality Environment filed a motion shortly after Penn-Mar Ethanol could not come up with the funding to purchase the land for the distillery, stating that if Penn-Mar didnt even own the land they were fighting for, than the whole appeal was pointless. The court agreed with them and said Penn-Mar Ethanol had no standing. They threw the appeal out before it had a chance to be heard in oral arguments next week. The Citizens for a Quality Environment said they are not surprised by the courts decision. "I would like to take all the credit, but Id have to say that their inability to obtain the money to buy the land, let alone build the facility is just the kiss of death for this project. It has been since it all started in Connoy Township four or five years ago," said Fred Antoun, attorney for Citizens for a Quality Environment. In Pennsylvania, a person cant submit building plans for approval in a zoning hearing or ask for permission to build if they dont own the land. The only way for the Penn-Mar Ethanol plant to come back around again in Franklin County is for the developers to start the re-application process all over again. It doesnt look likely.
