NEW MARKET, MD - New information has been released on the Monday accident that killed two people south of New Market in Frederick County.

Maryland State Police say the commercial truck had brake problems. They say three out of 10 brakes were not working when the tractor trailer lost control around a curve and landed on top of the pick-up truck, killing the two people inside.

State police say three other brakes were also out of adjustment. This was discovered during inspections on Monday and Tuesday after the accident. They say the commercial truck had not paid apportionment fees in Maryland and was not legally allowed to drive in the state.

State police say they also believe there were falsifications in the log book by the co-driver, Erochenel Bernadin. They say the driver, Watson Pierre, did not have a log book. Watson is charged with criminally negligent homicide and failure to control speed.
