BERKELEY COUNTY, WV - A competency evaluation shows Donald Surber will be able to stand trial on murder charges for the death of his ex-girlfriend, Katherine Sharp.
Surber is accused of stabbing Sharp to death. Her body was found in her Martinsburg home after Surber was involved in a 26-hour standoff with police.
Dr. Christi Cooper-Lehki, a child psychiatrist, completed Surber's evaluation and deemed him competent.
In a previous hearing, Judge Christopher Wilkes ordered that a second competency evaluation be conducted on Surber because there were delays in Cooper-Lehki's report.
Court records show Cooper-Lehki "was confused by the direction of the Court" and there was an "inability of the parties to deliver complete discovery to her."
An order was filed to rescind the second evaluation.
